What you have to do

The accounting officer and systems

A business should be able to show that it can answer yes to these: Does the municipal manager, as accounting officer, understand responsibility for financial administration, including guiding the council and officials on compliance with the Act? Do you have appropriate systems for financial administration, assets, liabilities, revenue and expenditure, including internal control and risk management? Do you pay creditors within 30 days of receiving the invoice or statement, unless otherwise agreed? Has the council delegated supply chain management powers to the municipal manager in writing, as the regulations require?

Budget and in-year reporting

A business should be able to show that it can answer yes to these: Do you approve an annual budget before the start of the financial year and spend only in line with it? Do you report monthly on implementation of the budget to the National Treasury and the provincial treasury? Do you complete the mid-year budget and performance assessment and consider an adjustments budget where needed?

Annual statements, audit and the annual report

A business should be able to show that it can answer yes to these: Do you submit annual financial statements to the Auditor-General within two months after the end of the financial year (31 August for a 30 June year-end)? Do you prepare an annual report, table it in council, and make it public, with the oversight report that follows? Do you act on audit findings, with an action plan overseen by the audit committee and the municipal public accounts committee?

Irregular spending and consequences

A business should be able to show that it can answer yes to these: Do you record, investigate and report unauthorised, irregular, and fruitless and wasteful expenditure, and recover or write off the losses as the Act and circulars require?

How to comply, step by step

  1. The accounting officer and systems. Run a yearly MFMA induction for the municipal manager, section 56 managers and council. Review the control environment against the National Treasury MFMA implementation checklist. Track invoice ageing monthly and report late payments to the municipal manager. Check the delegation register and review it after each council term.
  2. Budget and in-year reporting. Keep the budget timetable, council resolutions and adjustment budgets on file. Submit the monthly budget statement by its due date and keep the acknowledgement. Put the mid-year assessment in the council calendar and brief the mayor on the outcome.
  3. Annual statements, audit and the annual report. Plan the year-end close, and note that National Treasury sometimes extends timelines by circular. Follow the annual report timetable, and publish the report on your website. Track every audit finding to closure with an owner and a due date.
  4. Irregular spending and consequences. Keep a register for each type of expenditure and take each case to the council committee that deals with it.

Is this guide written by a lawyer?

No. It was assembled from the public sources listed below and has not been reviewed by a lawyer. Treat it as a starting point and check the current law before relying on it.
