What you have to do
Fidelity Fund Certificate
A business should be able to show that it can answer yes to these: Does every property practitioner in the business hold a valid Fidelity Fund Certificate from the PPRA, and does nobody act without one? Is the certificate displayed as the Act and Regulations require? Do you diarise certificate renewal well before it expires?
Trust account and client money
A business should be able to show that it can answer yes to these: Is money received for clients paid into a trust account kept separate from your own money, or handled through an arrangement the Regulations allow? Are trust accounting records kept up to date and reconciled? Is an auditor appointed and the trust account audit report produced and submitted as required?
Mandates, disclosure and FICA
A business should be able to show that it can answer yes to these: Are sale and rental mandates in writing with the content the Act and Regulations require? Is the prescribed mandatory disclosure form completed and kept on every file? Do you identify clients, keep records and report suspicious transactions as the Financial Intelligence Centre Act requires? Do you log complaints and their outcomes?
How to comply, step by step
- Fidelity Fund Certificate. Check each person on the PPRA practitioner search and keep a register with expiry dates. Display it at the premises and in the places the Regulations require. Reports say certificates renew every three years. Set reminders and confirm the period with the PPRA.
- Trust account and client money. Keep bank confirmation and a record of how each deposit is linked to a client. Reconcile at least monthly and have a second person review it. Confirm the audit period and submission date with the PPRA and diarise them.
- Mandates, disclosure and FICA. Use a mandate template checked against the current Regulations. Train staff on when it applies and keep a signed copy. See the FICA assessment and register with the FIC if you are an accountable institution. Keep a complaints register and give clients the PPRA contact details.
