What you have to do

Registration and returns

A business should be able to show that it can answer yes to these: Are you registered for every tax type that applies to you (income tax, VAT, PAYE, UIF, SDL, customs) and do you keep that registration up to date? Do you submit every return SARS requires by its due date, even when the return shows nothing to pay? Is every return based on complete and accurate information, and do you correct errors you find by submitting a revised return? Do you check your eFiling profile for messages, requests for information and assessments regularly, and respond within the time given?

Records

A business should be able to show that it can answer yes to these: Do you keep the books, records and documents needed to meet your tax obligations and show SARS you comply, in an orderly form? Do you keep records for at least five years, and longer where SARS has started an audit or you did not file a return? If you keep records electronically, are they kept in South Africa (unless a senior SARS official has allowed otherwise) and can you produce them in a readable form?

Penalties, audits and disputes

A business should be able to show that it can answer yes to these: Do you pay tax when it is due, and understand that late payment brings interest and that non-compliance can bring penalties? If SARS audits you or asks for information, do you know who responds, and do you reply on time with complete documents? If you disagree with an assessment, do you know how to lodge an objection within the period allowed and appeal if needed? If you find you have under-declared or missed a return, do you consider the Voluntary Disclosure Programme before SARS finds it?

How to comply, step by step

  1. Registration and returns. List the taxes that apply to you and check each is registered on eFiling. Update details when they change. Use a single calendar for all returns, with an owner for each. Late filing can bring penalties. Review each return before submitting, and correct mistakes as soon as you find them. Give two people access to the eFiling profile, and check it at least weekly.
  2. Records. Keep an organised filing system, paper or electronic, with a clear owner. Set a five-year retention rule, with a hold on records under audit. Check where your accounting and cloud storage hold your records, and get SARS authorisation if they sit outside the country.
  3. Penalties, audits and disputes. Diarise payment dates and set up reminders. If you cannot pay, contact SARS about a payment arrangement before the due date. Name a responsible person and keep supporting documents ready for the main tax types. Check the current objection period on the SARS site (it is counted in business days), and keep the supporting documents. Take advice from a tax practitioner before disclosing. A valid, voluntary disclosure can reduce penalties and avoid prosecution.
