What you have to do

Registration and who is covered

A business should be able to show that it can answer yes to these: Are you registered with the Unemployment Insurance Fund (UIF) as an employer, and do you have your UIF reference number? Have you registered every employee, including part-time, fixed-term and domestic workers, and not counted any as exempt without checking? Do you tell the UIF when an employee starts, leaves or when their details change?

Contributions

A business should be able to show that it can answer yes to these: Do you deduct 1% of each employee's remuneration for UIF and add 1% from the employer, up to the monthly remuneration ceiling? Do you pay the contributions to SARS or the UIF by the seventh of the following month (or the last business day before it when the seventh falls on a weekend or holiday)? Is the remuneration you use for UIF the same as the amounts in your payroll and your PAYE returns? Do you pay over the amounts you deducted from employees, and never use them for another purpose?

Declarations, records and claims

A business should be able to show that it can answer yes to these: Do you submit a monthly declaration of your employees and their remuneration (through uFiling or your SARS return)? Do you keep payroll and UIF records for each employee, including hours, remuneration, contributions and dates of employment? When an employee leaves, do you give them a UI-19 form or equivalent declaration so they can claim benefits? Do you know that employees can claim benefits for unemployment, maternity, parental, adoption, illness and death, and do you help them with the documents the UIF needs?

How to comply, step by step

  1. Registration and who is covered. Register on the Department of Employment and Labour's uFiling system and keep the reference number. Check each person's hours and status, and register every covered employee. Household employers register each worker. Update uFiling every month with new starters and leavers, with correct ID numbers and dates.
  2. Contributions. Set the payroll to cap contributions at the ceiling, and check the figure when it changes. Pay with your monthly EMP201 or through uFiling, and set a reminder for the due date. Reconcile UIF, PAYE and payroll each month, and correct differences promptly. Pay deductions on time, as non-payment can lead to penalties, interest and prosecution.
  3. Declarations, records and claims. Make the monthly declaration part of your payroll close, and file it even if there is a change in staff. Keep records in a form you can produce for the UIF or an inspector. Check the retention period. Complete the UI-19 on termination and give a copy to the employee promptly. Tell staff about UIF benefits in your leave policy, and complete employer sections of claim forms quickly.
