What is VAT Act?
16 yes/no questions on VAT for South African businesses: whether you must be registered, tax invoices, claiming input tax, returns and payments, and records. You get a score for each area and a list of gaps with what to do about each one.
- Official name
- VAT Act
- Status
- In force. Shown as in force as we understand it. Check the current text with the regulator or an attorney, since provisions can be amended or commence at different times.
Who it applies to
- Whether it applies to you depends on your size, activities and licences. Use the free "Which laws apply to me?" checker, or read the first section of the self-assessment.
- You must register as a VAT vendor once your taxable supplies in any 12-month period exceed the compulsory threshold, or are likely to. The threshold was reported as raised in 2026 (to R2.3 million, with the voluntary threshold at R120,000), but I could not confirm the figures on SARS's own site, so check SARS before relying on them.
What you have to do
Registration
A business should be able to show that it can answer yes to these: Do you check your taxable turnover against the compulsory VAT registration threshold on a rolling 12-month basis, including signed contracts that will take you over it? If you went over the threshold, did you apply to register within the time SARS allows (reported as 21 days)? If you are registered voluntarily, do you meet the conditions (a bank account, proper accounting records and a fixed place of business)? Do you tell SARS promptly when your details change (address, banking, directors or the nature of the business)?
Tax invoices and claiming input tax
A business should be able to show that it can answer yes to these: Do you issue a valid tax invoice for every taxable supply, including the words 'tax invoice', your name, address and VAT number, the customer's details, the date, the description and the amount of VAT? Do you issue credit and debit notes when an invoice is adjusted, instead of altering the original? Do you claim input tax only on valid tax invoices (or equivalent documents) for goods and services used in making taxable supplies? Do you split input tax correctly where purchases are used for both taxable and exempt supplies, or for private use? Do you apply the right rate: the standard rate, zero rating (for example certain exports and basic foodstuffs) or exempt status?
Returns, payments and records
A business should be able to show that it can answer yes to these: Do you know your VAT tax period (for example every two months, or monthly) and its due dates? Do you submit your VAT201 return and pay by the due date, which is reported as the 25th of the month after the period end (the last business day when the 25th falls on a weekend or holiday)? Do you reconcile your VAT return to your accounting records before you submit it? Do you pay any penalties and interest promptly and correct errors from earlier periods in the next return or by voluntary disclosure? Do you keep all VAT records (invoices, credit notes, import documents, ledgers and returns) for at least five years? If SARS queries or assesses you, do you have a way to respond in time and object within the allowed period? Do you understand VAT offences and penalties, such as failing to register, issuing false invoices or failing to file returns?
How to comply, step by step
- Registration. Add a monthly rolling 12-month turnover check and write down the date you will cross the threshold. Register on eFiling as soon as you know. Late registration can lead to VAT liability, penalties and interest from the date you should have registered. Answer Not applicable if you are below the threshold and not registered. Keep your bank account, books and business address in order. SARS can refuse or cancel registration if not. Answer Not applicable if you are registered compulsorily or not registered. Keep your eFiling profile and VAT registration details up to date.
- Tax invoices and claiming input tax. Check your invoice template against the s20 list and the SARS guide for tax invoices. Make credit notes a standard step for returns and corrections, and keep them with the original. Check each claim has a valid tax invoice, and does not include items for which input tax is denied, such as entertainment. Apportion mixed-use purchases with a documented method. Answer Not applicable if all your supplies are taxable and business-only. Document the VAT treatment for each product or service line, and ask SARS or an adviser when unsure.
- Returns, payments and records. Put each period's due date in your compliance calendar. Answer Not applicable if you are not a VAT vendor. File and pay on eFiling by the due date, even if the return is a nil return. Check the due date on SARS's calendar. Answer Not applicable if you are not a VAT vendor. Reconcile output and input tax to the ledger every period, and keep the working papers. Correct errors as soon as you find them. SARS imposes penalties and interest on late payment. Keep your records for five years in written or electronic form, in a way SARS can access. Name who deals with SARS, set up eFiling alerts, and keep supporting documents ready. Brief your finance team on the main offences, and have an accountant review your VAT process once a year.
