I, the undersigned,

Full name and surname: [Your full name and surname]

Identity number: [Your identity number]

hereby declare under oath as follows:

  1. The contents of this statement are, to the best of my knowledge, a true reflection of the facts.
  2. I am a member, director or owner of the following enterprise and am duly authorised to act on its behalf. Enterprise name: [Enterprise name]. Trading name (if applicable): [Trading name (if different)]. Registration number: [Registration number (or ID number for a sole proprietor)]. Enterprise physical address: [Enterprise physical address]. Type of entity: (Pty) Ltd. Nature of business: [Nature of business].
  3. I declare under oath that the enterprise is [Black ownership (percentage)]% black owned, [Black woman ownership (percentage)]% black woman owned and [Black designated group ownership (percentage)]% owned by black designated groups, as measured under Code Series 100 of the Amended Codes of Good Practice issued under section 9(1) of the Broad-Based Black Economic Empowerment Act 53 of 2003 as amended. When to use it

  • Your annual total revenue is R10 million or less and you are not in a sector with its own code that changes the threshold
  • A customer, tender or supplier portal asks for your B-BBEE status
  • You are a sole proprietor, close corporation or (Pty) Ltd and you are a director, member or owner

Before you use it

  • This follows the general exempted micro enterprise affidavit in common use. Some sectors have their own code and their own affidavit with a different threshold (for example tourism and marketing), and some customers insist on their own form. Check which applies and use the official dtic template if you are asked to
  • It is only valid once you have signed it in front of a Commissioner of Oaths, who signs and stamps it on the same day. An unsigned printout has no effect
  • Everything in it must be true. A false B-BBEE affidavit is a criminal offence under the B-BBEE Act
  • Revenue means annual total revenue for your latest financial year, taken from your financial statements or management accounts
  • The ownership percentages must be calculated under the Ownership element of the codes (the flow-through principle applies where a company owns the enterprise). If you are not sure, ask your accountant or a B-BBEE verification agency before you swear
  • It is valid for 12 months from the date the Commissioner signs it
