Mining compliance in South Africa

Mining right holders, contractors on mine sites and the suppliers who are asked about their compliance.

A guide, not legal advice. What applies to you depends on your size, activities and licences. Check the detail with the law, the regulator or an attorney.

Laws that usually apply

Mine Health and Safety Act

Employers must keep a safe working environment, assess and respond to risk, consult health and safety committees, and investigate and report accidents within the periods the Act sets.

Mining Charter

Holders of mining rights must meet the Charter's transformation requirements.

NEMA (Environmental Management)

Mining brings environmental duties, authorisations and rehabilitation obligations. Check the activities you carry out.

National Water Act

Water use and discharge from mining activities usually need authorisation.

National Environmental Management: Air Quality Act

Listed activities that emit pollutants need an atmospheric emission licence.

National Environmental Management: Waste Act

Mining waste and waste management activities can be regulated.

COIDA (Injury on Duty Cover)

Employers register for injury-on-duty cover, and principals often ask contractors for good standing.

BCEA (Basic Conditions of Employment)

Shift work, overtime and leave are regulated.

LRA (Labour Relations)

Retrenchments, discipline and strikes are common in the sector.

UIF (Unemployment Insurance)

Employers register and contribute for their employees.

Immigration Act (Employer Duties)

Employers must check that every worker is allowed to work, including workers supplied by contractors.

POPIA Compliance

You hold personal and medical information about workers, which has stricter conditions for processing.

Templates you will probably need

What customers, tenders and funders often ask to see

  • Health and safety policy and risk assessments
  • Letter of good standing from the Compensation Fund
  • B-BBEE or Mining Charter evidence for tenders and principals
  • Incident and training records

The Mine Health and Safety Regulations, codes of practice, mining right conditions, social and labour plans and rehabilitation financial provision are outside our self-assessments. The Mine Health and Safety Act is covered by a framework guide and controls but not yet a self-assessment.

How ComplianceDesk helps

  1. Take the self-assessments above and see your gaps, free and without an account.
  2. Save a result to your organisation and each gap becomes a task with an owner and a due date.
  3. Fill in a template, save it to your Policy Library and track who has acknowledged it.
  4. Choose the filing dates that apply on the compliance calendar and get an email before each one.

Questions

Does using ComplianceDesk make us compliant?

No. The self-assessments show where you have gaps against each law and give you tasks, templates and reminders to close them. Compliance depends on what you actually do, and the content is a guide that an attorney should review before you rely on it.

Can I try the self-assessments without an account?

Yes. Every self-assessment is free to take, and your answers stay in your browser until you choose to save a result to an organisation.

Track it all in one place

ComplianceDesk turns each law into controls with owners, due dates and evidence.
